Terms of Use

These Terms of Service ("Terms") govern your use of goodmorningkolkata.com and the GoodMorning Kolkata service (the "Service"), operated by K Network ("we", "us"). By creating an account or using the Service, you agree to these Terms and our Privacy Policy. If you don't agree, don't use the Service.

1. Eligibility

You must be 18 years of age or older to create an account or use the Service. By using the Service, you confirm you meet this requirement.

2. Your account

• You must provide accurate information when you sign up, and keep it up to date.
• You are responsible for everything that happens under your account, and for keeping your password confidential. Tell us immediately at support@goodmorningkolkata.com if you suspect unauthorised access.
• We offer optional two-factor authentication — we recommend turning it on.
• You may sign in with a password, or with Google or LinkedIn (see our Privacy Policy §5–6 for what that involves).
• One account per person. You may not share, sell or transfer your account.

3. Acceptable use

You agree not to:

• post anything unlawful, defamatory, harassing, hateful, or that infringes someone else's rights;
• impersonate any person or organisation, or misrepresent your affiliation with one;
• post spam, or use the Service to run unsolicited commercial messages;
• post a business listing, job or event you don't have the right or authority to post;
• misuse the anonymous-idea feature to harass, defame or evade accountability;
• attempt to access another user's account, or any part of the Service you're not authorised to access;
• scrape, crawl or bulk-collect data from the Service other than what standard search-engine crawling allows;
• upload malicious code, or attempt to disrupt or overload the Service;
• use the Service for anything illegal under Indian law.

We may remove content, suspend or terminate an account that breaches this section, at our discretion, with or without notice depending on severity — see §7.

4. Your content and our licence to it

• You own what you post. Posts, ideas, comments, business listings, reviews, photos and other content you submit ("your content") remain yours.
• The licence you give us: by posting content, you grant GoodMorning Kolkata a worldwide, non-exclusive, royalty-free licence to host, store, reproduce, display, adapt (for formatting, thumbnails and similar technical purposes) and distribute your content, solely to operate, promote and improve the Service. This licence ends when you delete the content or your account, except for content already shared by others, or copies kept for backups or legal reasons for a limited period.
• You're responsible for your content — that you have the rights to post it, and that it doesn't break these Terms or the law.
• Anonymous ideas are still subject to this licence and to moderation; anonymity affects who can see the author, not your responsibility for the content.

5. Business listings, jobs, and events — not a party, no guarantees

GoodMorning Kolkata is a directory and community platform. When you list a business, post or apply to a job, or host or attend an event through the Service:

• We are not a party to any resulting agreement, employment, transaction or relationship between users (for example, between an employer and an applicant, or between a business and a customer);
• We don't verify the accuracy of listings, job postings, applicant claims or event details beyond the limited verification described in our Privacy Policy (a business's website or email);
• Payments, if any, happen off this platform — we do not process payments between users, and we're not responsible for any payment dispute;
• We make no guarantees about the outcome of any job application, business relationship, or event, or about any user's conduct, reliability or identity;
• Use your own judgement, and follow ordinary precautions, when dealing with other users.

6. Intellectual property

The GoodMorning Kolkata name, logo, design and platform (excluding your content and other users' content) are owned by K Network or our licensors and protected by applicable intellectual property law. You may not copy, modify or create derivative works from the Service itself without our written permission.

7. Moderation, suspension and termination

• We may remove content, or restrict, suspend or terminate an account, that violates these Terms, our Community Guidelines, or the law, or that we reasonably believe creates risk or legal exposure for us or other users.
• You may delete your account at any time — see our data deletion instructions.
• Sections that by their nature should survive termination (including §4's surviving licence scope, §6, §9 and §10) continue to apply after your account ends.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent the law allows. We don't warrant that the Service will be uninterrupted, error-free, or free of harmful components.

9. Limitation of liability

To the maximum extent permitted by law, K Network and its officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data, goodwill or other intangible losses, arising from your use of the Service or any content, transaction or relationship facilitated through it — including anything arising from §5.

10. Indemnity

You agree to indemnify and hold K Network harmless from any claim, damage, loss or expense (including reasonable legal fees) arising from your content, your use of the Service, or your violation of these Terms or of any third party's rights.

11. Governing law and disputes

These Terms are governed by the laws of India. Subject to any mandatory consumer-protection rules that apply to you, the courts of Kolkata, West Bengal, India have exclusive jurisdiction over any dispute arising from these Terms or the Service.

12. Changes to these Terms

We may update these Terms as the Service changes. If we make a material change, we'll post the update here with a new "Last updated" date and, for significant changes, notify you by email or an in-app notice before it takes effect. Continuing to use the Service after a change takes effect means you accept the updated Terms.
